Terms and Conditions

Above-Ground Baiting & Colony Control

  1. Purpose of Treatment
    Above-ground baiting and colony control treatments are designed to manage and reduce termite activity by attracting termites to bait stations placed in identified areas of activity. These treatments are a recognised method of termite management but cannot be guaranteed to eliminate all termites or prevent future infestations.
  2. No Guarantee of Termite Engagement
    While every effort is made to install, monitor, and maintain bait stations according to industry best practice, we cannot control whether termites will enter or consume the bait. Factors such as environmental changes, disturbance of bait stations, or termites abandoning an area may limit effectiveness.Accordingly, we do not guarantee that termites will feed on the bait or that colony elimination will occur.
  3. Due Diligence
    We commit to exercising all reasonable care and due diligence in the placement, monitoring, and replenishment of bait stations. This includes:

    • Correct installation of bait units.
    • Scheduled inspections and replenishment where activity is detected.
    • Documentation of all service visits.

    However, as termite behaviour is unpredictable and outside of our control, the outcome cannot be assured.

  4. Disturbance & Interference
    The effectiveness of above-ground baiting may be compromised by:

    • Building or renovation works.
    • Landscaping, gardening, or tree removal.
    • Plumbing, electrical, or other trade work.
    • Alterations to soil levels, drainage, or subfloor areas.
    • Any disturbance, tampering, or removal of bait stations.
    • The use of domestic insect sprays, surface sprays, or other DIY pest control chemicals prior to or during treatment.

    Such actions may cause termites to abandon feeding areas, making treatment significantly more difficult or, in some cases, impossible. We do not accept responsibility for reduced effectiveness or failure of the system where disturbance or interference has occurred.

  5. Non-Refundable Payments
    All payments for colony control services are strictly non-refundable. This includes circumstances where:

    • Termites do not enter the bait stations.
    • Termite activity ceases or shifts to other areas.
    • Baits are disturbed, tampered with, or rendered ineffective by external factors including building, gardening, or other site works.
    • Previous application of sprays, insecticides, or other chemicals has disrupted termite activity.

    By engaging our colony control service, you acknowledge and accept that payment covers the provision of professional time, expertise, materials, and ongoing monitoring—not a guaranteed result.

  6. Limitations of Liability
    Our liability is limited to performing services with due care and skill. We do not accept responsibility for:

    • Damage caused by termites that do not engage with the bait system.
    • Re-infestations occurring outside treated or monitored areas.
    • Termite activity that resumes after a period of inactivity.
    • Any loss or damage caused by disturbances, alterations, or chemical treatments applied by others.

    No warranties, express or implied, are made regarding the complete eradication of termites or future termite-free conditions.

Payment Terms

  1. Payment Terms
    Payment is due in full upon receipt of this invoice, unless otherwise agreed in writing prior to the commencement of services.
  2. Non-Refundable Policy
    All deposits and payments are strictly non-refundable under any circumstances. By making payment, the client acknowledges and accepts this condition in full. No claims, chargebacks, or cancellations will alter this policy.
  3. Restocking / Administration Fee
    If a refund is granted at the sole discretion of ACT Pest Control, an administration fee equal to 30% of the total invoice amount will be deducted prior to any refund being processed.
  4. Exceptions
    Any exception to this policy must be expressly authorised in writing by a director of ACT Pest Control. No verbal agreements, assumptions, or implied terms will override these conditions.
  5. Dispute Resolution
    All disputes or claims in connection with these terms will be governed exclusively by the laws of the Australian Capital Territory (ACT). The client irrevocably agrees to submit to the exclusive jurisdiction of the courts in the ACT.
